The European Commission today formally asked to 'Italy and Spain to fully implement European legislation on energy performance of buildings, opening to them an infringement of Community law.
In this case, reminiscent of a statement issued in Brussels, that legislation should allow European citizens to benefit from all the useful information on buying or renting buildings. It also has

"The Commission's decisions are issued in the form of reasoned opinions. If, within two months has not taken any steps to ensure the adaptation, the Commission may decide to take the Member States before the Court of Justice," the statement said EU Commission.
The purpose of European legislation is to significantly reduce the energy consumption of buildings and thereby contribute to the fight against global warming and strengthen energy security of the EU. Substantial energy savings can also dramatically reduce the energy bill of each household, Brussels says.
"The Commission considers that Italy and Spain have not adopted all the measures envisaged by the European legislation," says the note. In particular, as regards Italy, the provisions of Italian legislation regarding the certification of energy performance of buildings do not meet the requirements set by the Directive.
Italy has also taken no steps on the obligation of regular inspections of air conditioning systems to gauge their performance.
Spain instead, says the EU Commission has not yet adopted a methodology for calculating the energy performance, nor a system of certification that all interests existing buildings. The English system of inspection of boilers also does not affect plants in operation before the entry into force of legislation.
The infringement procedure, it is recalled in the note refers to the legislation of the European Parliament and the Council of 16 December 2002, Energy Performance of Buildings, OJ L 1, 4.1.2003. The Directive requires Member States to adopt a methodology for calculating the integrated energy performance of buildings and laying down minimum energy performance requirements applicable to new buildings and existing large floor area subject to major renovations.
When constructed, sold or lease of a building, the prospective buyer or tenant must receive a certificate of energy efficiency, enabling him to compare and evaluate the energy performance and gain a better understanding of energy bills. The certificate is also accompanied by recommendations for improving energy efficiency.
This attestation system and the system of inspection of boilers and air conditioning systems are required by January 4, 2009.
